1. Introduction

Welcome to the Tracking the Wild mobile application (“the App”) and website (including all webpages, subdomains and subparts therein contained) (“the Site”) owned and operated by Tracking the Wild (Pty) Ltd, its affiliates, agents and licensors (collectively "Tracking the Wild", "we", "us" and/or "our").

This Privacy Policy sets forth our policy with respect to the information, including personally identifiable information ("Personal Information"), that is collected from users (including through those users' agents) ("you" or "your"). Tracking the Wild recognizes and respects the importance of maintaining the privacy of your Personal Information and established this Privacy Policy as a result. Please read this Privacy Policy carefully as it includes important information regarding your Personal Information. By visiting our Site and/or downloading the App through the Site or through other mobile application stores, you are accepting the Privacy Policy as published on our Site.

2. Your Consent

By using the Site and/or the App or allowing someone to use the Site and/or on your behalf, you are consenting to our collection, use, disclosure, transfer and storage in accordance with this Privacy Policy of any Personal Information or other information received by Tracking the Wild as a result of such use.

You can use the Site without giving Tracking the Wild any Personal Information. However, additional services may be available to you if Tracking the Wild has certain Personal Information provided by you, such as your email address, Yahoo, Gmail, Twitter and/or Facebook account which shall be used for the purposes of your personal login details.

3. The Information we Collect

3.1      Personal Information

You do not have to give us personally identifiable information (“Personal Information”) in order to visit our Site. Personal Information shall be provided when upon downloading and use of the App. As a result of those actions, you may supply us with such information as your name, organisation, website, phone number, e-mail address and/or contact preferences. If we collect Personal Information from you, you are giving us permission to use that information for the specific purpose as set out in the App and/or the Site Terms and Conditions for which it is provided.

3.2      Non-Personal Information

When you interact with the Site and/or the App, we automatically collect certain personally non-identifiable information ("Non-Personal Information"). The Non-Personal Information we collect includes without limitation, your Internet Protocol (“IP”) address, domain name of your internet service provider, your approximate geographic location, your purchase history, a record of the Site pages that you visit, the time of your visits and aggregated Personal Information that cannot be used to specifically identify you. Such information, which is collected passively using various technologies is strictly for statistical purposes and to determine the visitor traffic patterns through the Site and cannot, in and of itself, be used to specifically identify you.

3.3      Cookies

In operating the Site, we use a technology called "Cookies." Cookies are small text files that provide Non-Personal Information to us regarding the visitors to our Site. Our Cookies provide additional functionality to the Site and assists in personalising your online experience. It further helps us analyse Site usage more accurately and allows us to gauge the areas that are of the most interest to our visitors.

3.4      Aggregated Personal Information

In an on-going effort to better understand and serve the users of the Site and the App, Tracking the Wild often conducts researches on its customer demographics, interests and behaviour based on Personal Information and other information that it collects. This research may be compiled and analysed on an aggregate basis and this aggregate information is strictly for statistical purposes and does not identify you personally and therefore is considered and treated as Non-Personal Information under this Privacy Policy.  

4. Our Disclosure of Information that we Collect

Tracking the Wild is not in the business of selling or supplying your Personal Information to any third parties. We consider this information to be required to enable us to give effect to the various uses of the App. There are, however, certain circumstances in which we may disclose, transfer or share your Personal Information with certain third parties without your consent, as set forth below:

4.1      Business Transfers

In the event of a corporate sale, merger, reorganization, dissolution or similar event, Personal Information may be part of the transferred assets. We may also share your Personal Information with our subsidiaries and/or affiliates for purposes consistent with this Privacy Policy and legislation regulating the use of personal information. Our subsidiaries and affiliates will be bound to maintain that Personal Information in accordance with this Privacy Policy.

4.2      Agents, Consultants and Related Third Parties

Tracking the Wild sometimes engages other companies to perform certain administrative and/or business-related functions which, inter alia, include maintaining the database and communications network and processing. Tracking the Wild uses its best endeavours that such third party has the necessary security measures in place to ensure the integrity of the user’s Personal Information and is line with the provisions of this Privacy Policy. You agree and acknowledge that Tracking the Wild is not responsible for the unlawful conduct of any agents, consultants or other related third parties, with respect to your Personal Information, except if as a result of the gross negligence of Tracking the Wild.

4.3      Legal Requirements

Tracking the Wild may disclose your Personal Information if required to do so by law or in the good faith belief that such action is necessary (i) to comply with a legal obligation, (ii) to protect and defend the rights or property of Tracking the Wild, (iii) to act in urgent circumstances to protect the personal safety of users of the Site and/or the App or (iv) to protect Tracking the Wild against legal liability.

4.4      Non-Personal Information

As Non-Personal Information cannot be used to personally identify you, Tracking the Wild may disclose, transfer or share Non-Personal Information for any lawful purpose. Non-Personal Information relating to the animal population and population dynamics will from time to time be provided to the Animal Demography Unit, a research unit of the University of Cape Town, the Endangered Wildlife Trust and other research or scientific organizations which they may use for statistical purposes.

5. How to Protect the Information we Collect

Tracking the Wild has put in place certain measures to ensure the security of the Personal Information we collect and to secure the correct use thereof and in doing so makes use of the hosting services of Hetzner (Pty) Ltd (“Hetzner”). The security measures include internal reviews of our data collection, storage and processing practices and security measures. Tracking the Wild takes reasonable steps to ensure the reliability of our own staff and ensure that any person who processes information on our behalf reaches the same high standards that we set ourselves and limit their access to your Personal Information to what is necessary in order for them to perform their responsibilities. These individuals are bound by confidentiality obligations. All transaction information are stored on secure computers located in locked data centres to which only selected employees have access. If any account abuse is detected and identified, any information which Hertzner may have available shall be forwarded to you by Tracking the Wild should you wish to conduct any further investigations.  We will ask for your express permission before we use your Personal Information for any purpose not disclosed above.

Tracking the Wild takes what it believes to be reasonable steps to protect the Personal Information provided via the Site and/or the App from loss, misuse, unauthorized access, inadvertent disclosure, alteration, and destruction. Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your Personal Information, we cannot guarantee the security of your data transmitted to our Site and/or the App and any such transmission is at your own risk. Website maintenance on your mobile device and/or personal computer and the security thereof is your sole responsibility.

6. Privacy Laws

Use of the Site and/or the App and any electronic transaction concluded with Tracking the Wild are governed by the laws of the Republic of South Africa. If the user accesses this Site and/or the App from locations outside of the Republic of South Africa, that user is responsible for compliance with all local laws.

7. Other Terms and Conditions

This Privacy Policy is incorporated into our App Terms and Conditions and Site Terms and Conditions respectively, and governs your use of the Site and the App and/or any electronic transactions concluded with Tracking the Wild.

8. Changes to Privacy Policy

The Site and/or any other information displayed on the Site and/or the App may change from time to time. As a result, at times it may be necessary for Tracking the Wild to make changes to the Site and this Privacy Policy. Tracking the Wild reserves the right to update or modify its Site and/or the App and this Privacy Policy at any time and without prior notice to you. Please review this Privacy Policy periodically and especially before you provide any Personal Information to us. Your continued use of the Site, after any changes or revisions thereto or to this Privacy Policy, shall indicate your agreement with the terms of such revised Privacy Policy.

Our Site and the App may contain links to and from the websites of our advertisers and/or affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please familiarise yourself with these policies before you submit any Personal Information to these websites.
